Company Context Heroes s.r.o., Czech company registration number 179 63 508, with registered office at Příčná 1892/4, Nové Město, 110 00 Prague 1, Czech Republic, registered in the Commercial Register kept by the Metropolitan Court in Prague, Czech Republic, Section C, File 378938 (hereinafter referred to as "Controller" or "we"), issues this Privacy Policy (hereinafter referred to as "Policy"), which aims to provide clients with clear and transparent information about the purposes and methods of processing personal data, about the different categories of personal data processed, their potential recipients, the retention period of personal data as well as your rights and how to exercise them in connection with your communication with us via the contact form at www.contextheroes.com.

The Controller fully respects the rights, freedoms and privacy of natural persons, and therefore the protection of personal data is one of its most important priorities. The Controller protects all personal data collected as confidential and handles it in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), and in accordance with other data protection legislation.

The Controller informs that this privacy policy applies only to its clients and persons who contact it via the contact form on the website www.contextheroes.com, in particular to request the services of a language service provider.

When processing personal data, the Controller respects the following basic principles in particular:

  • personal data must be processed correctly and in a lawful and transparent manner in relation to the data subject;

  • personal data must be collected for specified, explicit and legitimate purposes and may not be further processed in a way that is incompatible with these purposes;

  • personal data must be adequate, relevant and limited to what is necessary in relation to the purpose for which they are processed;

  • personal data must be accurate and, where necessary, updated;

  • personal data must be stored in a form which permits identification of data subjects for no longer than is necessary for the purposes for which they are processed;

  • personal data must be processed in a way that ensures their proper security and prevents unauthorized or accidental access, alteration, destruction, loss or damage, unauthorized transfer, unlawful processing or other misuse.

The data controller is the company Context Heroes s.r.o., Czech company registration number 179 63 508, mentioned above. No data protection officer has been appointed.

The personal data subject may be a natural person or a representative of a juridical person who is interested in concluding or has concluded a contract for the provision of translation or localization services by the Controller and for this purpose contacts us via the contact form (hereinafter referred to as the "Subject"). 

1. PROCESSED PERSONAL DATA

The Controller processes the following personal data:

  • identification data – name and surname, address of residence or registered office, VAT number, tax identification number, or date of birth,

  • contact details – e-mail address, telephone number, LinkedIn profile,

  • data related to the performance of the contract – services order, personal data (if included in the translated text), bank account details, details of payments made and invoiced,

  • other data – the content of the communication we have with you as the person requesting our services, the content of the texts we translate for you if they contain personal data.

The Controller shall process the personal data which the Subject has voluntarily provided to the Controller.

The Controller does not process special categories of personal data.

2. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

The Controller processes personal data on the basis of:

  • fulfilling the legal obligation – archiving tax documents for 10 years from the end of the tax period in accordance with Act No. 235/2004 Sb on value added tax, as amended,

  • performance of the contract – for the purpose of concluding and performing the contract, we process your identification data, data related to the performance of the contract and, where applicable, other data that may be contained in documents provided by you,

  • the legitimate interest of the Controller – on the basis of our legitimate interest, we process your name, surname and contact details in order to be able to contact you in the future with an offer of our services, on the basis of our legitimate interest we may also process data on outstanding payments.

3. PURPOSES OF THE PROCESSING 

The principal grounds and purposes for processing personal data are as follows:

  • Receiving and dealing with enquiries about our services or any questions you may have.

  • Conclusion of a contract with you based on your inquiry.

  • Compliance with legal regulations, in particular those relating to the storing and retention of tax documents.

  • Direct marketing in the form of sending commercial communications and newsletters, service offers and information about news and promotions to your e-mail address; your personal data may be processed in order to pursue our legitimate interests in the form of limited direct marketing, so consent is not required, but you are entitled to opt out of direct marketing at any time.

4. TRANSFER OF PERSONAL DATA TO THIRD PARTIES

We may transfer personal data to the following recipients or categories of recipients:

  • our partners who are in the position of personal data processors and are obliged to handle personal data in accordance with data protection legislation; we always have a personal data processing agreement with such entities, if we use them, which guarantees you essentially the same protection as if only the Controller were involved in the processing of personal data,

  • the company Breezy s.r.o., Czech company registration number 277 33 823, which provides our contact form and our website,

  • we may use external translators to translate documents, and we have always concluded personal data processing agreements and a confidentiality agreement with these translators, which guarantees you essentially the same protection as if only the Controller were involved in the processing of personal data,

  • application providers and online tool providers,

  • other entities, if necessary to protect the rights of the Controller, e.g. attorneys, courts, bailiffs (the scope of the personal data provided is limited to the data necessary for the successful assertion of the claim).

Personal data may be processed through various applications, online tools, and cloud services. In certain cases, personal data may be transferred outside the territory of the Czech Republic or the European Union. For example, we use the Google Workspace service (including Google Sheets), provided by Google LLC. Google is listed among the entities certified under the EU-U.S. Data Privacy Framework (the “DPF”) which allows for the transfer of personal data to the United States based on an adequacy decision as defined in the Article 45 of the GDPR. In cases where the DPF is not applicable, international transfers of personal data are based on standard contractual clauses or other appropriate safeguards (pursuant to Articles 46 and 47 of the GDPR).

5. AUTOMATED PROCESSING AND PROFILING

The Controller does not carry out automated processing and profiling.

6. PERSONAL DATA PROCESSING PERIOD

We process your personal data contained in tax documents for as long as we are required by law. In accordance with Act No. 235/2004 Sb on value added tax, as amended, we keep these tax documents for 10 years from the end of the tax period.

We keep your personal data, which we process for the purpose of contacting you to offer our services, for 3 years. In the event a contract is entered into for direct marketing purposes, we process personal data for the duration of the contractual relationship and for a subsequent period of 3 years following its termination.

We keep your personal data that we process on the basis of the performance of the contract and on the basis of our legitimate interest, namely data on outstanding payments, for the standard limitation period, i.e. for 3 years from the due date of the invoice for the services provided.

7. SECURITY OF PERSONAL DATA

Taking into account the state of the equipment, the cost of implementation, the nature, scope, context and purposes of the processing, as well as the differently likely and differently serious risks to the rights and freedoms of natural persons, the Controller has taken appropriate technical and organizational measures to safeguard personal data against accidental or unlawful destruction, loss, alteration or unauthorized disclosure, disclosure or other access. The measures include in particular the following:

  • regular data backups,

  • updates to antivirus software systems,

  • data encryption,

  • organizational measures (employee confidentiality, rules of safe work on work equipment including the principles of personal data protection, access to all systems, including the information system, being personalized and protected by passwords, regular training of employees on the rules of safe handling of personal data, especially on work equipment).

 8. RIGHTS OF THE SUBJECT

Where the Controller processes your personal data, you are in the position of a data subject. In connection with the processing of your personal data, you are entitled to the following rights under the conditions set out in the legislation.

Right of access to personal data
You have the right to obtain information about whether the Controller processes personal data concerning you, and if so, you also have the right to access this personal data and to receive information about what data the Controller processes about you, for what purpose, for how long, how it obtains your personal data, to whom it is transferred, who processes it and what other rights you have in relation to the processing of your personal data. Within this right, you may also request a copy of the personal data processed, provided that this does not adversely affect the rights and freedoms of other persons. The first copy will be provided to you free of charge; further copies may already be subject to a reasonable charge in respect of the administrative costs involved in making them.

Right to rectification of personal data
You have the right to have inaccurate personal data concerning you corrected or incomplete personal data concerning you completed without undue delay, including by providing an additional declaration.

Right to erasure of personal data
In some cases, you have the right to have personal data concerning you deleted without undue delay.

Right to restriction of personal data processing
In some cases, you have the right to request that the processing of personal data concerning you be restricted for a certain period of time.

Right to personal data portability
You have the right to obtain personal data concerning you in a structured, commonly used and machine-readable format and to request that this data be transferred to another controller, where the processing of personal data is based on your consent or on a contract to which you are a party and is carried out by automated means. In the event that the exercise of this right would adversely affect the rights and freedoms of other persons, it will not be possible to comply with your request.

Right to object to the personal data processing
You have the right to object to the processing of personal data concerning you that is based on the legitimate interest of the Controller or a third party. The Controller will cease processing your data if it does not have compelling legitimate grounds for further processing which override your interests or rights and freedoms or for the establishment, exercise or defense of legal claims.

If you object to the processing of your personal data for direct marketing purposes, the Controller will cease to process such personal data without further action.

The right to withdraw consent to the processing of personal data at any time

Right to lodge a complaint
You also have the right to lodge a complaint with the supervisory authority, which is the Personal Data Protection Office, located at Pplk. Sochora 27, 170 00 Prague 7, Czech Republic, especially if you believe that your personal data is processed by the Controller unlawfully or in violation of generally binding legal regulations.  How to exercise individual rights

In all matters related to the processing of your personal data, you can contact the Controller through the contacts listed in this Policy.

The Controller reserves the right to verify, in a reasonable manner, the identity of the data subject exercising any of the aforementioned rights. Upon your request, the Controller shall provide you with information on the measures taken or the reasons for not taking the measures without undue delay, but no later than one month after receipt of the request. This time limit may be extended by a further two months if necessary, taking into account the complexity and number of requests. We will inform you of the extension of the deadline, together with the reasons for the delay, no later than one month after receipt of your request.

If your request is not granted, you can contact us again and you can also file a complaint with the supervisory authority, which is the Czech Personal Data Protection Office. You can also seek judicial protection.

The Controller shall provide information and take action on the basis of your request free of charge. However, if the requests made are manifestly unfounded or unreasonable, in particular because they are repetitive, the Controller may impose a reasonable fee to take into account the administrative costs involved in providing the information or taking action, or may refuse to comply with the request and will inform you of this.

This form aims to facilitate the exercise of the aforementioned rights of the Subject with the Controller. If you wish to exercise your rights, please send this form to Context Heroes using one of the contact details listed below.

9. CHANGES TO THE POLICY

If any provision of this Policy becomes invalid, ineffective or unenforceable, the remaining provisions of this Policy shall remain in full force and effect.

The Controller reserves the right to update this Policy periodically to the appropriate extent.
